Important: product model

We sell standalone install packs only (pre-built Docker images + LICENSE file + install/upgrade scripts) for deployment on servers you own or rent. We do not provide cloud SaaS email hosting or multi-tenant sending through the Site. After deployment, business data (CRM, contacts, send logs, etc.) resides on your server under your control.

1. Definitions

• Install Pack: pre-built Docker images, LICENSE.env, install/upgrade materials; no Git source code unless a separate written enterprise source order applies.
• LICENSE: order-bound authorization file stating daily send limits, domain slots, VPS groups, branding mode, maintenance expiry, etc.
• Authorized install: optional one-time remote deployment using credentials you voluntarily submit.
• Site account: account used to sign in, order, download, authorize install, and receive notifications.

2. Acceptance

By registering, checking the agreement box, checking out, or downloading, you accept these Terms and our 隐私政策. If you do not agree, do not purchase or use the Software.

3. Accounts and purchases

1. Provide accurate registration information and keep credentials secure.
2. Plan names, daily limits, and prices are as shown on the plans page (usually USD; Alipay checkout converts at the prevailing rate).
3. Install-pack orders are generally one download and one activation; resale, rental, or redistribution of packs or LICENSE files is prohibited.
4. If you plan to use authorized install, we recommend contacting support via in-site private message or support@bigsocialboss.com before payment to confirm server readiness and process.

4. Software license

Subject to full payment and compliance with these Terms, we grant a non-exclusive, non-transferable, non-sublicensable license to:

• Run one activated instance on one server matching your order tier;
• Use within LICENSE limits (daily sends, domain slots, VPS groups);
• Experience tier (~3,000 sends/calendar day) or perpetual tiers as stated in your delivered LICENSE.

You may not:

• Bypass or tamper with LICENSE enforcement;
• Reverse engineer or extract source from images except where law expressly permits;
• Supply packs, images, or LICENSE files to third parties or deploy on unauthorized machines;
• Remove lawful branding except during an active whitelabel entitlement.

5. Delivery, install, and upgrades

1. After payment, the Site provides download access and LICENSE; you may self-install or choose authorized install.
2. Authorized install: you authorize us to use submitted IP, SSH port, username, and password/key only for this order’s one-time deployment and verification. Credentials are encrypted on our servers, retained for 7 days for failure troubleshooting or support requests, then deleted when no open ticket remains. Change server passwords after install.
3. Experience tier recommendation: ≥ 2 GB RAM, Ubuntu 22.04 LTS, public IPv4; 1 GB RAM is trial-only and may fail or be unstable.
4. Upgrades and security patches depend on maintenance subscription scope and official docs (e.g. upgrade.sh).

6. Fees and refunds

Digital goods: install packs, LICENSE files, and add-on maintenance are non-refundable and non-exchangeable once paid and delivered or recorded, including mistaken purchases, change of mind, unsuitable server environment, domain/ICP/DNS issues, cloud provider actions, or user error.

Maintenance subscriptions (e.g. standard $59/year) renew per plan page rules; lapse does not revoke perpetual software license but may end update/support entitlements.

7. Acceptable use

You are solely responsible for lists, content, and sending on your server. You must not use the Software to:

• Send unsolicited or unlawful commercial email;
• Send phishing, fraud, malware, or illegal content;
• Mail purchased or scraped lists without proper consent;
• Attack our systems or third parties.

Use truthful sender identity and working unsubscribe flows; comply with CAN-SPAM, GDPR, PRC personal information rules, and local laws. You bear complaints, blocks, claims, and penalties; we may deny support and pursue legal remedies.

8. Support and maintenance

• Optional maintenance includes security updates and support within stated scope via in-site messages, email, and published phone.
• Not covered: your hardware/network, provider outages/blocks, domain filing, DNS errors, recipient filtering, IP blocklists, etc.
• Within 7 days after payment, report install issues via in-site support with order ID for discretionary assistance (not a refund obligation).

9. Intellectual property

Software, UI, docs, Site content, and BigSocialBoss branding remain our or licensors’ property. You retain rights in your templates, lists, and content. See 版权声明.

10. Disclaimer and liability cap

Software is provided “as is”. We do not guarantee deliverability, inbox placement, uptime, or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, consequential, profit, or data loss damages. Our aggregate liability for any claim is capped at amounts you actually paid for the disputed order (mandatory law excepted).

11. Suspension and termination

Material breach may result in denial of downloads, maintenance, and support. Technical LICENSE limits still apply to delivered perpetual rights. You may stop using the Software at any time; contact support to close Site accounts.

12. Governing law

These Terms are governed by the laws of the Hong Kong SAR. Disputes shall be submitted to the courts of Hong Kong after good-faith negotiation unless otherwise agreed in writing.

13. Changes

We may update these Terms on the Site. Material changes will be reasonably highlighted. Continued purchase or use constitutes acceptance.
